Record retention: how long, and why

Deleting a paper too early is a deficiency you cannot repair. Keeping everything with no plan isn’t a plan either. Here is what you need to know.

HIPAA: compliance documentation and clinical records

The Security Rule requires its compliance documentation to be retained for six years from creation or the date it was last in effect, whichever is later. HHS clarifies that HIPAA does not set a general medical record retention period.

The layers by paper type

Define the retention period and the event that starts it for each document type. In Florida, review nurse registry rules, including clinical record requirements, and any applicable contractual or preservation obligations.

Legal hold: when nothing gets touched

Facing a dispute, an investigation or a records request, scheduled destruction FREEZES — that is a legal hold. It must be applicable per patient, per document or for the whole clinic, and it must leave a trail of who placed it and why. Purging a paper under hold is among the most expensive mistakes there are.
